Grande Cay Recreation Association Rental, Lease, Non-Rental, and Long-Term Guest Processes Registration and Application Procedures Overview: The following is the process to follow for rental, lease, non-rental, and long-term Guests approvals
Definitions: Renter: A non-owner who compensates an owner for occupying a unit for 90 days or less. Lessee: A non-owner who pays compensation for occupying a unit for more than 90 days. Long-term Guest: A non-owner who occupies a unit greater than 10 days without compensating the owner. Guest: A non-owner who occupies a unit 10 days or less without compensating the owner Tenant: A Renter, Lessee, Long-term Guest, or Guest Forms: For rentals or lease, at least four forms must be completed and received by Suitor & Associates, Inc. at least 10 days prior to the start date. These forms are the following: Gulf Harbour Yacht and Country Club Rental Form, which requires a $50 registration fee along with the first page of the rental agreement. The $50 fee is payable to Suitor & Associates, Inc. and Rental Application (Grande Cay), which requires two fees; $100 and $25 fees. The $100 fee is payable to the Grande Cay Recreation Association. The other fee, $25, is an administration fee payable to Suitor & Associates, Inc. This fee is can increase depending upon the residence of the applicant. If the applicant’s residence is outside of the USA, than the fee can be greater. and Wachenhut Gulf Harbour Yacht & Country Club Permanent Access Form is required. Even though there is no fee, this form is essential in order for the tenant’s name to be recorded with Security. This form can be faxed to Suitor at 239-765-1034 or sent as an e-mail attachment to Suitor to the attention of Dawn Belom (dawnbelom@comcast.net) or Michelle Pacitto (michellepacitto@comcast.net) and The Grande Cay Recreation Association Lease/Rental Agreement Form must be signed by the prospective renter, lessee, or long-term guest and returned to Suitor. One copy will be given to the prospective renter, lessee, or long-term guest for reference. There are two versions of this form; the Short Form and the Long Form”. Renters and Long-term Guests must sign the Short Form. Lessees must sign the Long Form. and possibly An owner can allow only an annual lessee to maintain a pet but a Grande Cay Recreation Association Renter Pet Application and $10.00 fee must be submitted. However, even though an owner can allow pets in their unit by tenants, the Association discourages such arrangements. The Process – Rentals and Leases: 1. Suitor provides all of the above forms. All forms will be returned to Suitor with the appropriate fees. Of particular note is the Grande Cay Recreation Association Lease/Rental Agreement Form. Renters must sign the Short Form. Lessees must sign the Long Form. Two copies of either the Long Form or the Short Form will be provided for signature and date. One will be returned to Suitor. (The other will be a reference for the renter or lessee.) 2. Suitor will do a background check. If the applicant’s address is outside of the USA, then Suitor will notify the applicant if additional charges are required for completion of the background check. All fees will need to be received before Suitor initiates the background check. The 10-day period will start when all fees and completed applications are submitted. 3. Both the Rental Application (Grande Cay) and the Grande Cay Recreation Association Lease/Rental Agreement Form will be provided to the designated person of the Grande Cay Oversight Committee. Social Security number(s) will be deleted from the Rental Application (Grande Cay) upon submission to the Grande Cay Oversight Committee from Suitor. 4. Within 72 hours, the Grande Cay Oversight Committee will review the application and provide a recommendation to the Designated Board Member of the Grande Cay Board for approval or denial. It is acknowledged that the Grande Cay Oversight Committee does not have the authority to approve or deny an application. 5. The Designated Board Member provides a response to Suitor (approval or denial) within 10 days from Suitor’s receipt of the application. 6. The status of the application is provided to the Grande Cay Oversight Committee also within 10 days from Suitor’s receipt of the application. The Process - Long-Term Guests 1. Long-term Guests must sign the Short Form of the Grande Cay Recreation Association Lease/Rental Agreement Form. Two copies of either the Short Form will be provided for signature and date. One will be returned to Suitor. (The other will be a reference for the renter, lessee, or long-term guest.) 2. The Wachenhut Gulf Harbour Yacht & Country Club Permanent Access Form is required. The Process – Guests not accompanied by owners and guests with permanent access. Guests who are not accompanied by owners or guests that an owner would like to have permanent access, only the Wachenhut Gulf Harbour Yacht & Country Club Permanent Access Form is required. Violations Processes for Reporting, Documenting, and Correction including Fining Role of the GC Board, Fining Committee, and Oversight CommitteeGC Board is the only group authorized to fine; take action against a violator (including fining, towing or other actions), or authorized letters sent to the violator. Fining Committee will hear fining recommendations from the Board and vote yes or no. Oversight Committee receives, documents, and observes violations. When a violation occurs, the Oversight Committee initiates the Grande Cay Oversight Committee Violation Report and delivers it to the designated Board member or the GC Board. The violation will be discussed at a Board meeting. The Board may decide that the violation report is without merit and drop the case; it may decide to fine the violator and assign an amount; or decide to take other action. If a fine is the approved course of action, then a fining committee meeting will be called, and the case and amount of fine will be presented to the fining committee for a yes or no vote. The Process1. Violation of Rules and Regulations for Grande Cay is recorded on the Grande Cay Oversight Committee Violation Report and sent to a designated Board Member. Even though it is the Oversight Committee’s obligation to initiate this report, a Board Member can initiate this report. However, if a Board Member imitates the Grande Cay Oversight Committee Violation Report, a copy of the report should be provided to the Oversight Committee so that the Oversight Committee can fulfill its obligation to monitor the progress of the violation correction. 2. Only a designated Board Member or an individual of the Board Member’s choosing should interact verbally with the violator. The conversation should be provided to the Oversight Committee for recording on the Grande Cay Oversight Committee Violation Report. 3. If no correction occurs within a defined period of time (e.g. 10 days) to the verbal interaction, then letter is to be sent to violator (registered with return receipt). Only the Board authorizes the letter to be sent. No definitive action should be stated in the letter unless approved by the Board. However, statements such as “Fining, towing, etc. can be stated if stated as actions that could occur if action is not taken within a defined period of time.) An example might be “If your Dodge truck, license 1234 is not removed by August 20, towing could occur at your expense and/or other fines imposed.” A copy of letter is to be attached to the Grande Cay Oversight Committee Violation Report. 4. Repeat step three if the corrective action not taken. 5. If no correction occurs after the defined period expires, then the Oversight Committee documents this occurrence. The violation, with all documentation, including attachments, is presented to the Board for review. The Board will place the case on the agenda, discuss at the next meeting, and decide on an action, which may include fining. The Board’s action is recorded on the Grande Cay Oversight Committee Violation Report. Only the Board is authorized to fine or take corrective action against a violator. 6. If the Board chose fining as a course of action, a fining committee meeting will be called and the case merits and fine presented to the committee for a yes or no vote. The Grande Cay Oversight Committee Violation Report is maintained for each violation in order to track reoccurring violations from the same unit (i.e. Track Record).

Time/Day/Date/Place: 9:00 AM /Wednesday/April 19, 2006/GC Pool Attending: Irene Jakubowski (CHM), Mike Gill (Board Representative), Bill Banglesdorf (GC Board), Dennis Collins (GC Board, representing Document/Rules and Regulations Committee), Michelle Pacitto (Suitor & Ass.), John Fischetti (Gulf Harbour Security, Captain), Randy Ray, and Niles Kin Next Meeting: To be determined. Quorum: This meeting established a Committee quorum with 4 of 4 attending. Meeting: Minutes of 24 March 2006 meeting approved. Meeting Objective: The objective was to review the list of Master Association and Grande Cay Association Rules and Regulations with jointly with Gulf Harbour Security and Grande Cay’s Document/Rules and Regulations Committee that enforces rules and regulations. Discussion: Captain John Fischetti, Gulf Harbour Security, provided security issues for consideration. He noted that with the high use of day laborers, it is important to maintain security DURING THE DAY by keeping garage doors closed and personal items secured. He stated that many of these day laborers and not long-term employees but are only hired for the day. Many have limited transportation so it would be highly convenient for them to take a bicycle, for instance, so that can have their own transportation from where they would be dropped-off at the end of the day. Common Violations were reviewed, by topic (see attached, Common Violations). All commented as each item was discussed. A process was established for each item to be enforced and is noted on the attached. These processes were designated “A”, “B”, and “C”. All of these Processes have these common elements:
Process “A”: All incidents are to be reported to Gulf Harbour Security (for the purposes of these minutes, GHS). Cap. Fischetti recommended contracting the officer on-call directly rather than either gate at 340-8994. This objective is two-fold: first, to establish a written history of violations, second, to avoid direct confrontation between owners and/or renters. The first incident will be reported to GC Oversight Committee (Irene Jakubowski or her designee). GC Oversight Committee will send a letter to the owner. Process “B”: Includes Process “B” but the second letter would be sent to the owner from the GC Board. Fining would likely be recommended to Document/Rules and Regulations Committee. The Document/Rules and Regulations Committee will send letter to the owner. Process “C”: Considers violations that do not include Gulf Harbour Security (e.g. renting for less that 30 days, sub-leasing, etc.) These violations will go directly to GC Oversight Committee for consideration. If a violation has occurred, then the GC Oversight Committee will refer the violation to the GC Board who will consider referring it to the Document/Rules and Regulations Committee. Upon receipt of violation from the GC Board, the Document/Rules and Regulations Committee will then send a letter to the owner that includes a date for correction as well as a date for a hearing. Other Common Violations to ConsiderChildrenFurther consideration for the Common Violations was the wording of several items. Under Children, the age requirement of “Unsupervised on the Street or Swimming Pool” as discussed. The GC Oversight Committee will recommend to the GC Board that the age of 15 years old be established. Further, the GC Oversight Committee is recommending that a sign on or near the Pool Gate state that a parent must accompany all children under the age of 15 years old. If violations occur, Processes “A” and “B” will be applied as described above. Owners whose children are undisciplined in the street or swimming pool or owners who rent to renters, whose children are undisciplined in the street or swimming pool, will be subject to Processes “A” and “B”. Common Area
Renters A “No harm, no foul” policy will preside. However, all renters and guests must be registered. Corporations and individuals can rent to corporations and individuals. If violations consistently occur, the GC Oversight Committee may consider recommending to the GC Board not allowing the owner to renew their lease with the offending renter. The Grande Cay and Master Association Rules and Regulations must be attached to a lease agreement. Vehicles: The definition of a “pick-up Truck” has been enhanced to include a cover or Tanneau cover (hard or soft) over the loading bed. An outline with objections and proposed actions was presented by Irene following her Opening Statement. Irene will send this document. The consensus of the Committe was to merge the Master Association Documents with the Grande Cay Documents into an abridged by unofficial version. Upon this review, two objectives could be achieve, 1-better understanding and potential updating of the GC Docs for be achieved, 2-an abridged form could be provided to owners and renters as a guide. Mike and Irene will be doing a “cut and paste” of the Master Ass and GC Docs and have a rough draft by our next meeting. It was felt that in order to have strong encouragement for owners and renters to adhere to the Communities Rules, it is essential to be aware of the rules. Doing the above is essential to that end. As an example, Wachenhut is not aware of exactly what parking rules they should be enforcing since each community has different rules. Also, the residents not necessary Wachenhut are primarily responsible for reporting violations. After the rules are complied/abridged, they will be reviewed by Suitor then by Wachenhut. After review and approval by the GC Board, they will be provided to owners, renters, and Suitor. The method to provide this document to renters is under discussion. Also enforcement options are not known at this time, but it is anticipated that with discussions with the Master Association, Suitor, and Wachenhut, procedures will be developed. Niles Kin Oversight Committee Objectives: 1. To research and document The Master Associations And Grande Cay Rules & Regulations. Consolidate R&R’s in simple unified format for easy references for owners, renters and guests. Actions: A. Review Master Assoc. R & R’s. B. Extract and document R & R’s that apply for our Community. C. Review Grande Cay Assoc. R & R’s. D. Edit, reformat and merge with Master Assoc. R & R’s. E. Publish results. 2. Establish process and procedures for monitoring, addressing and correcting R & R’s infractions. Actions: A. Develop a list of the most common rules violations. B. Meet with WACKENHUT Captain John Feshetti and SUITOR & ASSOCIATES Representative Michelle Pacitto to review WACKENHUT policies and recommended procedures for addressing the violations list. C. Develop monitoring process for: * Parking violations * Renters violations * Guests violations * Living Unit violations * Common area : pool, lake, garages, garbage disp. areas, roads, driveways, etc. violations * Safety violations. D. Develop procedures for addressing and correcting R & R’s violations using WACKENHUT and Committee recommendations. E. Present R & R’s with procedures for addressing and correcting violations to THE BOARD Of DIRECTORS for approval. 3. To establish a renters/guests welcome which will help insure renters/guests are informed of the R & R’s of Grande Cay and Gulf Harbour.
